Our School of Private and Commercial Law, in collaboration with The Commercial Law Association of Australia, successfully hosted a half-day seminar focused on identifying and complying with fiduciary duties in the financial sector. We were honoured to hear an insightful keynote address from the Honourable Justice Ashley Black of the Supreme Court of NSW, alongside Associate Professor Scott Donald from UNSW Law & Justice. The event also featured a distinguished panel discussing compliance, enforcement, and remediation in the financial sector. Our expert panellists included Sarah Yu, Partner at , as well as esteemed professors Simone Degeling and Dimity Kingsford-Smith, and Joanna Bird, Regulatory Consultant and Adjunct Professor, all from UNSW Law & Justice.     Who leads lawyers?The rule of law in the UK is in a parlous state. Lawyers need leadership. Lawyers should not surrender their independence, nor should their representatives become members of shabby alliances with aims alien to fundamental professional values. One of my favourite lawyers from the past is former US Attorney General Robert Kennedy. Not only was he a relentless campaigner for civil rights, but despite suggestions that he was too inexperienced, he became a highly effective attorney general, rooting out corruption, and hugely increasing the convictions of organised crimes. Kennedy said: "Each time a man stands up for an ideal, or acts to improve a lot of others, or strikes out against injustice, he sends forth a tiny ripple of hope, and crossing each other from a million different centres of energy and daring, those ripples build a current which can sweep down the mightiest walls of oppression and resistance." Wonderful words matched with action. For lawyers from all backgrounds words matter. With powerful vested interests in the U.K. trying to oust professionally trained lawyers from a huge property market increasingly tainted by the payment of referral fees and other questionable practices, with the Post Office Horizon IT scandal hearing ever more shocking testimony about the behaviour of certain lawyers, who inspires lawyers today? Sadly there is a vacuum at the heart of the rule of law in the U.K. which was once filled by an independent Lord Chancellor and a powerful, self-regulating, Law Society but no more. Increasingly, rapacious commercial interests and overzealous regulatorsare filling the void. Solicitors have been given a rare opportunity to send out a powerful message, they will stop the rule of law from becoming a contaminated environment for justice and our land law system.A special general meeting of Law Society members will be held in person and online on Tuesday 23 July 2024.     Group litigation or class actions is on the rise in E&W, and as our law continues to develop and adapt to this growth, it’s important that parties to litigation actively consider the most appropriate procedural route to bring litigation and engage with each other where possible to agree. Here is another interesting case where the court has considered the use of a group litigation order/GLO - in this case the court decided its own case management powers were sufficient but it did a little “pick and mix” from the GLO procedure - which I think we will see much more of in the future!
